By registering for, purchasing from, participating in or otherwise using in any way the Dogasaur.com website (“Site), including the contents, products, and services provided by Dogasaur.com or any of its affiliates or subsidiaries, you hereby agree to the terms and conditions of this Waiver and Indemnity Agreement.

Changes to Terms and Conditions

We reserve the right to modify or terminate the Dogasaur.com service for any reason, and without notice, without liability to you or any third party. Eligibility and Registration

As part of the registration process, you will be asked to select a username and password and you will be responsible for all activities occurring under your username and for keeping your password secure. We may refuse to grant you a username that impersonates someone else, is or may be protected by trademark or proprietary rights law, or is vulgar, offensive or otherwise inappropriate, as determined by us in our sole discretion.

Use of Site

You may use or download material displayed on Dogasaur.com for noncommercial, personal use only. If you download matter, you must retain all copyright and other proprietary notices displayed on the materials. You may not distribute, modify, transmit, post or otherwise use the content of this Site and/or content contained in e-mails or other correspondence distributed to you from Dogasaur.com for public or commercial purposes without Dogasaur.com’s written permission. While Dogasaur.com prohibits such conduct and content on its site, you understand and agree that you nonetheless may be exposed to such Materials and that you use the Dogasaur.com service at your own risk.

We may, but shall have no obligation to, remove Materials that we determine in our sole discretion are unlawful, fraudulent, threatening, libelous, defamatory, obscene or otherwise objectionable, or infringes or violates any party's intellectual property or other proprietary rights or these Terms of Service.

By submitting, posting or displaying any Materials on or through the Dogasaur.com service, you automatically grant to us a worldwide, non-exclusive, royalty-free, right to publicly display or re-display such Materials in other formats not simply limited to websites.

Dogasaur.com disclaims any and all responsibility or liability for the accuracy, content, completeness, legality, reliability, or operability or availability of information or materials displayed on the Dogasaur.com service. Dogasaur.com disclaims any and all responsibility and liability for the conduct of any member or user of Dogasaur.com.

Hold Harmless and Indemnity

SUCH LIMITATION OF LIABILITY SHALL APPLY (I) WHETHER THE DAMAGES ARISE FROM USE OR MISUSE OF AND RELIANCE ON THE DOGASAUR.COM SERVICE, FROM INABILITY TO USE THE DOGASAUR.COM SERVICE, OR FROM THE INTERRUPTION, SUSPENSION, OR TERMINATION OF THE DOGASAUR.COM SERVICE (INCLUDING SUCH DAMAGES INCURRED BY THIRD PARTIES), AND (II) NOTWITHSTANDING ANY FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY AND TO THE FULLEST EXTENT PERMITTED BY LAW. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation and exclusions may not apply to you.

Jurisdiction and Venue

You agree that any action at law or in equity arising out of or relating to these terms of use or the Dogasaur.com website shall be filed, and that venue properly lies, only in state or federal courts located in Palm Beach County, Florida and you hereby consent and submit to the personal jurisdiction of such courts for the purposes of litigating any such action. We make no representation that content on Dogasaur.com is appropriate or available for use in any particular location. Those who choose to access Dogasaur.com do so on their own initiative and are responsible for compliance with all applicable laws including any applicable local laws.

Information Collection and Use

When you register to become a member of Dogasaur.com, we collect your name, email address and optionally your hometown, state and country. When you register your dog we collect the information you want to share about that canine such as name, age, likes, dislikes, sex, etc. Your name and email will never be shared, rented, bartered or sold with other users or third-party companies. All information entered about your dog(s) will only be used by Dogasaur.com to display on the site and will never be shared, rented, bartered, sold or exchanged. The website, however, is accessible by anyone with an internet connection and a web browser, which means that any words and photos you post can be copied by any other internet user. That is the nature of the internet and though we discourage anyone from abusing that option, it is something that must be noted.

Your name and email will never be shared with anyone in any way. If you chose to enter your hometown, state or country, that information will be displayed in any of your dog's web pages on the site, but the dog’s page does not share any other personal information or allow access to it.

The biographical information you enter about your dog(s) is instantly available to all other users of the site. Dogasaur.com does not claim rights for the pictures uploaded or the text information you add to the site. Please note, however, that Dogasaur.com is a public site and thus all photos and information you provide are available to anyone with internet access. Due to the nature of the internet you should never post a photo or fact that you do not now or ever want someone else to have access to.

Cookies. Cookies are small pieces of information that are stored as text files by your Internet browser on your computer's hard drive. Most Internet browsers are initially set to accept cookies. You can set your browser to refuse cookies from websites or to remove cookies from your hard drive, but if you do, you will not be able to access or use portions of this Dogasaur.com. This Site's cookies do not infiltrate a user's hard drive to gather a user's confidential information.

Web Beacons. Web beacons assist in delivering cookies and help us determine whether a web page on Dogasaur.com has been viewed and, if so, how many times.
